THE WORKTOP LIBRARY LTD – Terms and Conditions

1. General

These Terms and Conditions apply to all agreements between The Worktop Library Ltd (Company No. 12929729) and the customer. By accepting a quotation, placing an order, or allowing works to proceed, you agree to be bound by these Terms. Any variation must be agreed in writing.

2. Communication

All agreements, instructions, changes, and confirmations must be made in writing via email. Verbal or telephone discussions are not binding until confirmed in writing. We strongly recommend all project communication is kept via email for clarity and to maintain an accurate record.

3. Quotations

Quotations are based on information provided by the customer. You are responsible for reviewing all quotations carefully and notifying us of any discrepancies before acceptance. Once accepted, the quotation forms part of the contract.

We provide one detailed quotation revision free of charge. Further revisions may incur a fee.

We shall not be liable for errors that were reasonably identifiable prior to acceptance.

4. Templating

A responsible and authorised person must be present during templating. All relevant appliances (sinks, hobs, taps, etc.) should be on site or full manufacturer specifications provided in advance.

The templating fee is non-refundable once the template has been taken.

Failure to provide accurate information may result in additional costs, delays, or design adjustments.

5. Natural Stone & Material Variations

Natural stone is a product of nature and will contain variations in colour, veining, fissures, pits, and markings. These are inherent characteristics and not defects. Samples and photographs are indicative only.

6. Fabrication & Technical Decisions

Cutting plans are indicative. We reserve the right to adjust layouts, joint locations, and work around natural imperfections for structural integrity and best aesthetic result. Repairs and fillings are standard industry practice.

7. Joints, Seams & Tolerances

Joints are a normal part of stone installations. Minor variations in alignment, levels, and appearance are within acceptable industry tolerances.

8. Customer Responsibilities & Site Readiness

You are responsible for ensuring:

  • Cabinets are level, secure, and structurally sound
  • Adequate support is provided for undermount sinks and heavy items
  • The site is fully ready for templating and installation

We do not perform carpentry, structural work, plumbing, gas, or electrical connections.

9. Access & Installation Conditions

You must ensure safe access for large stone pieces. Restricted access may require design changes (additional joints) and/or extra costs.

10. Installation & Scheduling

Installation dates are estimates only. We cannot guarantee specific time slots. We are not liable for delays outside our reasonable control.

11. Plumbing, Gas & Electrical Works

We do not undertake plumbing, gas, or electrical work. All disconnections and final connections must be carried out by qualified professionals.

12. Sink & Hob Installation

We position sinks and hobs and apply silicone sealant. We do not provide or install structural supports for undermount sinks. You are responsible for ensuring adequate support.

13. Removal of Existing Worktops

We take reasonable care when removing existing worktops. However, we accept no liability for incidental damage to tiles, walls, cabinets, or other fixtures due to the condition of the existing installation.

14. Material Reservation & Cancellation

Once materials are reserved or ordered, they are allocated specifically to your project.

Cancellation or reduction after reservation or ordering may result in:

  • Supplier restocking/handling fees (up to 25% of the material cost)
  • Delivery and handling costs
  • Our reasonable administration and lost opportunity costs

In many cases, once material is processed or cut, it is non-refundable.

15. Payment Terms

50% deposit (or templating fee) prior to templating/material ordering.
Balance due at least 24 hours before installation.

Late payments attract statutory interest at 8% above the Bank of England base rate. We may suspend works until payment is received.

16. Inspection & Acceptance

You must inspect the installed worktops immediately upon completion in the presence of our team. Any visible defects must be reported before our team leaves site or confirmed in writing within 24 hours of installation. Failure to do so means the installation is deemed accepted for visible defects.

17. Limitation of Liability

Our liability is limited to the value of the goods and services supplied. We are not liable for indirect or consequential losses (to the extent permitted by law). Nothing in these Terms excludes liability for death, personal injury caused by negligence, or any liability that cannot be excluded under UK law.

18. Force Majeure

We are not liable for delays caused by events beyond our reasonable control.

19. Ownership of Goods

All goods remain the property of The Worktop Library Ltd until full payment is received.

20. Governing Law

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
